Terms & conditions
Payment: We require payment before collection or delivery in the form of cash, cleared cheque, Banker's draft or Debit or Credit card. There is a 2% handling charge on Credit Cards.
A business account requires two trade references and one bank reference for the following payment terms:
For orders up to £3000, payment due 30 days from the dispatch date.
For orders above £3000 or for special projects and commissions:
- 25% with order
- 50% when the goods are ready for despatch
- 25% on 30 day terms.
All varieties in our list are offered subject to availability, at the time we receive an order.
Prices stated are wholesale ex-nursery and subject to change without notice. Prices are exclusive of V.A.T.
Crown Topiary hereby reserves the property in any goods sold until payment of the price therefore is received in full.
Crown Topiary will maintain and care for the goods for a period of 6 months from the notified intent of purchase provided the buyer leaves a non-refundable deposit equal to 25% of the cost price.
Should the buyer cancel any unfulfilled order we reserve the right to demand 30% of the order value as liquidated damages without having to prove our action.
Cost of carriage will be borne by the buyer
The said goods shall be delivered to the buyer at the buyers place of business or as otherwise requested, but will not be off-loaded.
From the time of despatch hereof from the seller’s premises and until such delivery the risk of any loss or damage to or deterioration of the said goods from whatever cause arising shall be borne by the buyer.
No responsibility will be accepted by Crown Topiary for losses arising out of causes beyond its control.
Any description given of any goods is given by way of identification thereof only and the use of such description shall not constitute a sale by description.
Notwithstanding that a sample of any goods may be exhibited to and inspected by the buyer, it is hereby declared that such a sample is exhibited and inspected solely to enable the buyer to judge for his/herself the quality of the bulk and not so as to constitute a sale by sample under the contract. The buyer shall take the goods at his or her own risk as to their corresponding with the sample or as to their quality or sufficiency for any purpose.
Liability – Whilst every care will be taken to ensure that the customer’s instructions are adhered to, Crown Topiary will not be liable for any incorrect pricing howsoever caused.
Buyers shall be deemed to accept the above Conditions as a part of the Contract of Sale by placing an order with us. None of the above Terms and Conditions shall be deemed to be waived or modified unless expressly agreed by Crown Topiary in writing.
